None is present for the appellant. We heard Adv.Tanna for the Respondent. We are finding that the appellant had filed consumer complaint alleging deficiency in service on the part of BSNL, Yavatmal. According to appellant, he is a resident of Wani, Distt. Yavatmal and he was having two telephone connections provided by BSNL, one at his residence bearing No.5412 and another was in his shop bearing No.5321. It is pertinent to note that Telephone No.5321 was standing in the name of Keshao Biloriya and he was using said telephone in his PCO shop. The said telephone was in arrears of bills for Rs.23750/-. The arrears were demanded by the telephone department time and again but the appellant only once deposited Rs.1000/- and assured on 13/3/2000 that he would pay remaining amount in installments. However, he did not pay the installments and for these arrears, the BSNL Co, whose telephone the complainant was using for his own PCO, after giving notice to him, disconnected the telephone of the complainant. Hence he filed consumer complaint.

            After assessing all the facts, the forum was pleased to dismiss the complaint observing that the complainant was using the telephone for his PCO i.e. for a commercial purpose. He was using the telephone connection in the name of Keshao Biloriya unauthorizedly and even then did not bother to pay arrears of that telephone to the extent of Rs.23,750. Only once he paid Rs.1000/- and assured to pay the arrears. But he has not paid the same, and, therefore, the telephone department rightly disconnected the said connection No.5321.  We perused the impugned order. The appellant is absent. We are find that the findings recorded by the forum while dismissing the complaint are correct and the Forum rightly dismissed the complaint. We find no merit in this appeal. The action taken by the Respondent herein is just and proper and can not be called for in question. Hence the appeal is dismissed.

No order as to cost.

Inform the parties accordingly.
