Final Order / Judgement

Order No. 02 / 29 .11.2018

The Ld. Advocate for the Complainant t is present.

The case is taken up for hearing on the point of admission.

Heard the Ld. Advocate for the Complainant who submits that Complainant received a notice from the DLSA, South 24 Parganas to appear before the Lok Adalat on 29.07.2017 for settlement of Bill amount. He further submits that the telephone line was discontinued since 2005 and nothing is due in that respect though the Complainant deposited Rs. 2,000/- as security in respect of telephone No. 2351 2048.

Heard the submission of the Ld. Advocate for the Complainant. Perused the consumer complaint coupled with its annexure thereto. It is true that Complainant obtained a telephone connection being No. 2351 2048 from the OPs and deposited Rs.2,000/- as security. The grievance of the complainant is that the telephone was disconnected since 2005 and no telephone bill is due. In spite of that the Secretary, DLSA, South 24 Parganas issued a notice directing the complainant to appear before the Lok  Adalat  on 29.07.2017 to settle the dispute with the OPs. The matter was not settled as the OPs claimed the monthly rental charges. On perusal of the consumer complaint we do not file any allegation of deficiency in service as well as unfair trade practice against the OPs.  Complainant fails to produce any scrap of paper to establish that he disconnected the telephone connection and surrendered the telephone set to the telephone exchange. Therefore, the Complainant failed to establish his case against the OPs regarding deficiency of service as well as unfair trade practice.

In view of the above aspect, we are not inclined to admit the instant complaint. As such, the complaint is not admitted.
