Telephone of the petitioner was disconnected by the respondent on the ground of misuse of the telephone.  Petitioner being aggrieved filed the complaint before the District Forum.

District Forum allowed the complaint and directed the petitioner to reconnect the telephone without insisting on payment of rents or any other amount due for the period in between the date of disconnection till the date of reconnection; to pay compensation of

Rs.50/- per day from 11.1.2001 till the date of reconnection within                     30 days from the date of passing of the order, failing which the respondent was to pay compensation @ 100/- per day from the date of passing of the order till the date of reconnection.  Rs.2,000/- were awarded as costs.

Respondent being aggrieved filed the appeal before the State Commission.  The State Commission partly allowed the complaint.  Since the telephone had already been reconnected, the direction of the District Forum awarding compensation @ Rs.50/- per day from 11.1.2001 till the date of reconnection was set aside.  Rest of the order regarding payment of costs was upheld. 

Dissatisfied with the order passed by the State Commission, the complainant has filed the present revision petition.

We agree with the view taken by the State Commission.  The telephone of the petitioner was reconnected within the time prescribed without insisting on payment of rents or any other amount due for the period in between the date of disconnection.  Since the telephone had been reconnected within the time prescribed, the

direction given by the District Forum to pay compensation @ Rs.50/- per day from 11.1.2001 till the date of reconnection was rightly set aside.  Dismissed.
