The matter was called twice in the morning session but no one appeared on behalf of the petitioner. A notice was sent to the petitioner by Registered A.D. on 23rd October, 2009 directing him to remove the defects as also informing that the matter will be listed for admission on 4.1.2010. Notice of the petitioner has not been returned and it is presumed that the -2- petitioner has been served with the notice. Since no one has appeared on behalf of the petitioner today, the petition is hereby dismissed for non-prosecution with no order as to costs.
