Sh. Rajeev Bhargava named above herein the complainant has filed the present consumer complaint under section 12 of the Consumer Protection Act against Bharat Matrimony herein after referred as the opposite party for directions to the opposite party to refund Rs. 14583 /-with interest @ 2% and pay sum of Rs. 5,00,000/- as compensation on account of mental agony, harassment, inconvenience and sufferings caused by the opposite party to the complainant and his family stating that the complainant in January, 2012 approached the opposite party to avail matrimony services for his daughter Ms Aakansha Bhargava and vide receipt no. 58401 dated 09.01.2012 paid a sum of Rs. 45,000/-.The opposite party promised to send two profiles of suitable match proposal a week to the complainant and after approval theopposite party will communicate
with such suitable match. But the complainant never received two profiles of suitable match from the opposite party and whenever any profile received and communicated with the match and his family members caused harassment and insult to the complainant. The complainant sent several letters dated 02.06.2012, 02.08.2012 , 27.12.2012, 04.01.2013, 09.05.2013 and 23.07.2013 including notice dated 03.08.2013 to the opposite party to provide service and in default return the money. The opposite party did not respond to the letters and notice.The opposite party lastly refunded a sum of Rs. 20,417/- only out of total payment of Rs. 35,000/- and did not refund remaining amount of Rs. 14,583/-.Hence there is unfair trade practice and deficiency in service on the part of the opposite party. The complainant and his family member suffered mentally, physically and financially. Hence the present complaint.
Notice of the complaint wassent to the opposite party. But despite service of the notice none appeared on behalf of the opposite party.Therefore, the opposite party was proceeded ex-parte vide order dated 11.12.2013.
When Sh. Rajeev Bhargava complainant wasasked to lead ex-parte evidence by way of affidavit he tendered in ex-parte evidence his affidavit narrating facts of the complaint. The complainant also relied upon receipt no. 58401 dated 09.01.2012, cheque no. 525819 dated 03.05.2012 , letters dated13.12.2011, 03.02.2012, 09.02.2012, 29.02.2012, 06.03.2012,02.06.2012, 02.08.2012,27.12.2017, 04.01.2013, 23.07.2013 and 03.08.2013. The complainant also filed written arguments in support of his claim.
The version of the complainant, his affidavit and letters relied upon by him have remained unrebutted.Therefore, there is no reason to disbelieve the unrebutted and unchalledged version and evidence produced by the complainant. From perusal of receipt date 09.01.2012 and cheque dated 03.05.2012 the complainant succeeded to show that the opposite party on 09.01.2012 received a sum of Rs. 35,000/- from the complainant for providing matrimony services for Ms Aakansha Bhargavadaughter of the complainant . But the opposite party did not perform his part of the service. He did not provide profiles of suitable match for Ms Aakansha Bhargava as promised he also did not refund the money. Therefore, there is unfair trade practice and deficiency in service on the part of the opposite party. The complainant and his family suffered mentally, physically and financially. Therefore, we direct the opposite party to refund Rs. 14583/- with interest @ 9% per annum from the date of filing the present complaint till actual realization and pay Rs. 25,000/- on account of mental, physical and financial suffering and delay in marriage of daughter of the complainant.
