            Today is fixed for ex-parte hearing.  No step has been taken from the side of the complainant.  From the side of the O.Ps., a petition has been filed praying for time to file written version.  The record shows that the case has been fixed for ex-parte hearing.  So, the petition filed on behalf of the O.Ps. is not tenable.  Hence, the petition filed by the O.Ps., is rejected.

            The record is taken up for ex-parte hearing.  On repeated calls none appears from the side of the complainant.  On perusing the record it appears that on 25.2.2016 was fixed for ex-parte hearing.  Thereafter, more or less three adjournments were made on the basis of the prayer of the complainant and on last occasion on behalf of the complainant no step was taken.  The previous orders passed in this case clearly show that the complainant has lost his interest in respect of this case.  In the above premises, there is no alternative but to dismiss the case.  Hence, it is

Ordered

that the C.C. No.168/2015 is dismissed for default without any cost. 

Let the copies of this order be supplied to the parties free of cost.
