ORDER

JUSTICE J. M. MALIK, PRESIDING MEMBER(ORAL)

1.      Learned counsel for the petitioner present.  Arguments heard.

2.      The State Commission vide its order dated 8.10.2013 remanded the case to the District Forum, Patiala.  The State Commission found that the District Forum, Patiala has got jurisdiction to decide this case.  Learned counsel for the petitioner has supported his case with “British Airways Plc. Vs. Santosh Kumar & Ors.- revision petition No. 4090 of 2007, Nijhawan Travels Services Pvt. Ltd. Vs. Santosh Kumar & Ors.- revision petition No. 4158 of 2007 decided on 13.4.2012 and “U.S. Awasthy vs. Gulf Air & Anr.” IV (2003) CPJ – 114 (NC).

3.      The grievance of the petitioner is that the District Forum, Patiala is not hearing the case.  The State Commission has already decided this matter and we see no flaw in this order.  This question cannot be agitated time and again.  This question has already attained finality as it is not being called in question in these proceedings.

4.      The revision petition is without force, therefore, the same is dismissed.     The   District  Forum   is   directed  to decide the case

-3-

expeditiously and not more than 4 months from the next date of hearing.
