The complainant purchased a TATA vehicle from M/s Bhagyodaya Trokhos Pvt.Ltd., Authorized dealer for TATA vehicles, Hospet in Bellary district.

            The complaint is that the dealer has collected excess of Rs.1,30,499/- price for the vehicle, which is unfair trade practice.

            The complaint is that the vehicle has been registered in R.T.O. Office, Koppal as KA – 37/M-6012 and therefore this Forum has jurisdiction to adjudicate the dispute.

            Mere registration of the vehicle in Koppal do not create cause of action for the claim in respect of a transaction that occurred in Hospet within jurisdiction of Bellary District Forum.

            Hence, the complaint stands dismissed at the stage of admission for want of territorial jurisdiction.
