21/10/2014 -          In this case nobody is appearing on behalf of the petitioner, in spite of the orders dated 10.4.2014, 5.5.2014 and 15.10.2014 fixing this case for dismissing for non-prosecution/ for passing ex-parte order.

2.        This revision petition has been filed against the orders dated 12.4.2013 and 13.6.2013. The learned Lower Forum, by order dated 12.4.2013 directed the opposite party / petitioner to produce any local expert from Jharkhand / Bihar at his  own  cost  to  prove  the  signature of  the complainant/ Respondent  on disputed papers on the next date, failing which such opportunity will stand closed.

3.        By order dated 13.6.2013, the prayer of the opposite party/ petitioner that local expert is not available, was  rejected  on the ground that the Complaint Case was of the year 2008 and the opposite party /petitioner was delaying the disposal of the same on one pretext or other and was using delaying tactics to prolong the case.         The case was pending for four years and therefore the Learned Lower Forum refused to reconsider the matter afresh. The opposite party /petitioner was directed to argue the case on the next day i.e. on 27.6.2013, failing which the case was fixed for order. However, the learned Lower Forum gave an opportunity to the opposite party/ petitioner for filing revision, if any, against the said order.

4.        We do not find any reason to interfere with the said orders under revision. Accordingly this revision petition is dismissed. However, as nobody is appearing on behalf of the petitioner, we are not imposing costs.
