3.    Berkeley Automobiles Limited, Kalka, District Panchkula.

                        In compliance of the order dated 19.06.2014 passed by this Forum in compliant No.137 of 2012 and order dated 06.06.2016 passed by the Hon’ble National Commission in revision petition No.27 of 2016 and 28 of 2016, the Ops had made the payment of Rs.77,500/- on 16.07.2014 and Rs.77,500/- on 19.10.2015. However, the complainant vide application dated 18.12.2015 stated that an amount of Rs.42,123/- is still due. The Ops deposited a cheque dated 27.02.2016 amounting to Rs.40,531/. But no person had appeared on behalf of the complainant. Again OP deposited a cheque dated 02.08.2016 for an amount of Rs.40,531/-. The complainant is not appearing since 29.02.2016. The notices were issued to the complainant on 13.10.2016, 21.11.2016 and 03.01.2016 and the same were received with the reports “no such person/addressee moved”. From the above, it reveals that the complainant is not interested to pursue the present execution application. Hence, the application is disposed off accordingly.

                        A copy of this order be sent to the parties free of costs and file be consigned to record room after due compliance.
