Final Order / Judgement

 

The Ld. Advocate of both sides are present.

The case has come on transfer from Barasat Commission to this Commission pursuant to the order passed by the Hon’ble State Commission. Before transfer the case was at the stage of filing evidence by the complainant on affidavit. But the Ld. Advocates of both sides submit that the matter has been settled amicably between the parties out of the court and the entire paid amount has been refunded to the complainant by the OPs.

An application to that effect is filed by the Ld. Advocates and the application is supported by an agreement made by the parties amicably and also by money receipt. The complainant is also present before this Commission. It is ascertained from the Ld. Advocates that the paid amount was Rs. 75,000/- and the said amount has come to Rs. 1, 49,447/- due to accrual of interest @ 8% p.a. Therefore we think that it is a fit case for recording a dismissal order.

Hence it is ordered that the case be and the same is dismissed on full satisfaction. There will be no order as to cost.

Let a plain copy be given to the parties free of cost as per CPR.
