This is an appeal filed under Section-41 of the Consumer Protection Act 2019 against the judgment and order dated 07-02-2024 passed by District Consumer Commission, Ghaziabad in Complaint Case No. 294/2022.

Vide impugned judgment and order, the District Consumer Commission has allowed complaint and has passed the following order:-

परिवादी का परिवाद एकपक्षीय आंशिक स्‍वीकार किया जाता है। विपक्षी को आदेशित किया जाता है कि इस निर्णय के दिनांक से 30 दिन के अन्‍दर परिवादी के विरूद्ध दिनांक 13.05.2022 जारी बिल अंकन 13715रू.

निरस्‍त किया जाता है तथा मानसिक क्षतिपूर्ति एवं परिवाद व्‍यय हेतु 5000रू. की धनराशि परिवादी को अदा करें एवं परिवादी के यूनिट के आधार पर बिल पूर्व में जमा धनराशि तथा 5000रू. परिवाद व्‍यय एवं मानसिक क्षतिपूर्ति की धनराशि समायोजित करते हुये नया बिल जारी करे। बिल अदायगी के 30 दिन के अन्‍दर विपक्षी परिवादी का कनेक्‍शन चालू करे।   “

Feeling aggrieved with the impugned judgment and order passed by the District Consumer Commission, the opposite party Sub Divisional Officer, Electricity Distribution Sub Division, Ghaziabad has come up in appeal.

Sri Isar Husain, learned Counsel for the appellant/opposite party, U. P. Power Corporation appeared.

          Appeal has been filed with delay condonation application.  Appellant has shown sufficient reasons for the delay in filing the appeal. Cause shown for delay is explained, therefore, the delay is condoned.

I have heard learned Counsel for the appellant at the admission stage itself and have gone through the impugned judgment and order as well as records of the case.

The submission of the learned Counsel for the appellant/opposite party, U P Power Corporation Limited is that the order under challenge in this appeal is absolutely illegal, unjust, arbitrary besides being unreasonable and also lacks application of mind and the learned District Consumer Commission, Ghaziabad while allowing the complaint filed by the complainant, has illegally imposed the compensation towards mental agony and cost of the case Rs.5,000/- against the appellant/opposite party.

I have gone through the judgment of the District Consumer Commission and according to the finding recorded by the District Consumer Commission, I am of the opinion that the judgment has been passed by the District Consumer Commission after taking into

consideration the entire facts and material placed before it, so far as the compensation towards mental agony and cost of the case Rs.5,000/- are concerned, the same imposed by the District Consumer Commission are on the higher side and it should be reduced to Rs.2,500/-. Therefore, the appeal of the appellant/opposite party, U P Power Corporation Limited is liable to be allowed in part.

                                ORDER

The Appeal is allowed in part. The imposition of compensation and cost of the case by the District Consumer Commission is reduced to Rs.2,500/-. Rest of the order of the District Consumer Commission is upheld.

The amount deposited if any by the appellant under Section-41 of the Consumer Protection Act, 2019 in this appeal shall be remitted to the District Consumer Commission, Ghaziabad alongwith interest accrued, if any, in accordance with law.

Let copy of this order be made available to the parties as per rules.
