JUSTICE SHRI.P.Q.BARKATH ALI   : PRESIDENT

 

          It is seen from the records that the appellants who are opposite parties 1 to 3 before the forum is set exparte by the forum.  Taking into account the nature of the contentions raised by the parties I feel that an opportunity should be given to the appellants to contest the matter on merits.  Hence appeal is allowed.  Appellants shall pay cost Rs.5,000/- to the complainant.

          In the result, appeal is allowed. The impugned order of the Forum allowing the complaint is set aside.  The matter is remanded to the Forum for fresh disposal in accordance with law.  Both parties shall appear before the forum on March 30, 2017.   Appellants are permitted to deposit the cost before the forum.
