Bhattacharya, M.A. LL.B. WBHJS. Member : Shri P.K. Chatterjee. Member : Smt. Jhumki Saha. F I N A L O R D E R 1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.p. to pay compensation to the tune of Rs. 10,000/- and litigation costs of Rs. 5,000/- for non supply of thousand number of bricks though the o.p. received Rs. 1,500/- as advance on 07-07-2011 out of the total agreed amount of Rs. 5,500/-. 2. The o.p. in spite of receiving the summons did not appear. So the complaint was heard ex parte. 3. The only point requires determination whether the complainant is entitled to relief as prayed for ? DECISION WITH REASONS : 4. Both the points are taken up together for consideration. The money receipt reveals that the o.p. received Rs. 1,500/- as advance money out of Rs. 5,500/- for supplying 1000 number of bricks on 07-07-2011. On repeated requests the o.p. neither supplied the bricks nor paid back the money. So the prayer of the complainant shall be allowed. Both the points are accordingly disposed of. Hence, O R D E R E D That the C. C. Case No. 23 of 2014 ( HDF 23 of 2014 ) be and the same is allowed ex parte as against the o.p. with costs. The O.P. be directed to refund the sum of Rs. 1,500/- to the complainant together with interest @ 9% p.a. since November, 2011 within 30 days from the date of this order failing the amount shall carry interest @ 12% p.a. till full satisfaction. The o.p. do further pay Rs. 1,000/- to the complainant as compensation for causing harassment and Rs. 500/- as litigation costs.
