ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                           JUDGMENT

            Complainant has filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;

            “Direct the opposite parties to release the bills amounting to Rs.1,50,000/- from the dt.01.8.2018 to till date and pay Rs.50,000/- towards mental agony and litigation charges”.

            The brief fact of the case is that, the complainant has a computer unit at Paradeep since 2001. The opposite parties are prior acquaintance with the complainant they asked the complainant to open computer education in their school as per syllabus. The opposite parties along with other members of the institution gave a proposal that the complainant is to supply computers, its accessories i.e. table, chair etc. to the school since the school in question having no govt. aid and same is for a benevolent purpose and the act and ambition to generate the students for enabling them to teach computer etc. and for three months no money is to be given to the complainant. the complainant was agreed with the proposal and supplied the computer so also its accessories to the school in the year 2017 and the opposite parties agreed to pay Rs.5,000/- per month towards the fees of the complainant  from 01.8.2018 and further the opposite parties also afforded one room where the complainant also residing.  Since starting from the computer classes a single pie was not given to the complainant rather the complainant most of time appraised the opposite parties regarding his salary apart from this the complainant also separate money towards the computer maintenances.

            The complainant has supplied computer and accessories, table, chair etc. to opposite parties and complainant has taken fees as such the opposite parties are consumer of complainant but complainant has filed the case which is reverse in nature as such the complainant is not a consumer as defined under Consumer Protection Act and the present case is not maintainable under Consumer Protection Act. If the complainant has any grievance, he may approach appropriate Court of law for redressal of his grievance. With the aforesaid observation and direction consumer complaint is disposed of. No cost.
