JUDGEMENT
Mr. Purna Chandra Mishra, President.
Complainant Gokul Bihari Panigrahi has filed this case U/s 35 of CP Act-2019 alleging the deficiency of service on the part of the Opposition Party for not providing him the required information and praying therein for direction to the Opposite Party to provide him with the information as per his application and to pay compensation for harassment.
- Brief fact leading to the case is that the complainant had applied for information to PIO, Bandhagada Gram Panchayat on payment of fee of Rs. 10/-. Even though the application and fee was received by the Opposite Party, he did not provide him with the required information for which, he approached this Commission for direction to the Opposite Party to provide him with the required information.
- Notice was duly served on the Opposite Party and he preferred not to appear and challenged the allegation advanced against him. So, he was set expartee and this Commission proceeded to dispose of this case on his own merit.
- The complainant in support of this case has filed a copy of acknowledgement on 01.05.2017 issued by Basanta Kumar Konhar and copy of the IPO showing payment of Rs. 10/- to the PIO, Bandhagada Panchayat.
- As the OP did not appear, nor challenged the allegation raised against him it is deemed to have been admitted by him. As the complainant has paid the required fees and the Opposite Party did not provide him with the required information, a case of deficiency in service is made out against the OP and is liable to compensate the complainant for the loss and harassment sustained by him and hence the order.
O R D E R
The complaint petition is allowed ex partee against the Opposite Party. The OP is made liable for causing deficiency in service and harassment to the complainant. The Opposite Party is directed to provide the information as per the application within a period of 15 days from the date of order and to pay compensation of Rs. 10, 000/-(ten thousand)only and a sum of Rs. 2,000/-(two thousand)only towards cost of litigation. The order as to cost and compensation shall carry interest @ 12
% per annum from the date of order till its compliance.
