PER SHRI B.A. SHAIKH, HON’BLE PRESIDING MEMBER.

1.                None is present for the appellant.  Perusal of the record & proceedings of the appeal shows that  none appeared for the appellant  since long. Advocate  Mr. M. S. Nayyar  had appeared  for the appellant  and filed  power (V.P.) on 27/07/2015. On that  date direction  was given  to  issue notices to the  respondents  and appellant  to serve the same  to the respondents  by Registered Post A.D. Notices  issued to the respondents by this Commission  were  returned unserved  long back. The appellant  did not take further  steps  for service of notice to the respondents till 06/11/2015. The appeal was then adjourned til 03/02/2016. The record and  proceedings of  the appeal was misplaced after 06/11/2015. It was traced out on 24/04/2018 and hence,  on that date the appeal was taken  on board of this Commission. Therefore, direction  was given on 24/04/2018 to issue  notice of the appeal to the appellant.

2.         Accordingly, notice was issued  on 26/06/2018 to the appellant on  his same address given in the appeal memo. It was duly  served to the appellant  as seen from the acknowledgment  received duly signed by the appellant.  The appellant  failed  to appear on the given date i.e. on  14/08/2018. Therefore, on that date it was observed by this Commission, the appeal deserves to be dismissed  in default. The appeal came  to be adjourned  till this date for appropriate order. Today also none appeared for the  appellant  and no steps are taken  by the appellant  till  this date for service of notices to the respondent Nos. 1,2&3. Hence, the  appeal  deserves to be dismissed  in default.  Accordingly,  the appeal is dismissed  in default.
