ORDER

This appeal has been filed against order dated 19.05.2017 passed by District Consumer Disputes Redressal Forum-II, U.T., Chandigarh (in short ‘the Forum’).

                        After going through the order passed and also hearing Counsel for the parties, we are of the opinion that the complaint was such that it could not have been dismissed in limine at the initial stage. The complaint has issues, which need trial. So far as non-impleading of Credit Information Bureau (India) Limited (in short ‘CIBIL’) is concerned, we are of the view that CIBIL was not necessary party and further cause of action do arise because from the Website of CIBIL, anybody can see the status of Loan Account of an individual at any place in the country.

                        Faced with this situation, Counsel for the respondents state that let the matter be decided on merits.

                        In view of above, the appeal is allowed. Order dated 19.05.2017, under challenge, is set aside. The matter is remitted to the District Forum-II, U.T., Chandigarh, for decision a-fresh, after getting reply and evidence/affidavit of the respondents/Opposite Parties.

                        Parties/their Counsel are directed to appear before the District Forum-II, U.T., Chandigarh on 01.03.2018.

                        Certified copies of this order be sent to the parties, free of charge.

                        Complete record alongwith a certified copy of this order be sent to the Forum, immediately, so as to reach there before the date fixed.

                                File be consigned to the Record Room after completion.
