ORDER

Per Justice Shri S.B.Mhase, Hon'ble President:

      This appeal arises from an execution application no. 422/2008 decided by the District Consumer Disputes Redressal Forum , Kolhapur.  Appellant were punished to suffer simple imprisonment for one year.  Said order has been challenged under Section 27(1) of Consumer Protection Act, 1986.  At the time of final arguments the appellant has showed willingness to deposit the amount as per execution application and appellant has deposited the said amount on 15/05/2010 in the State Commission.  Now, the appellant and respondent have settled their dispute.  It has been decided that respondent shall take an amount of Rs.3,39,316/- which is deposited in the State Commission and appellant has no objection for releasing the said amount in favour of respondent nos. 1 to 4.  It is further agreed between the parties that since the respondent nos. 1 to 4 are receiving due amount as  agreed between them, they have no objection for setting aside the order of punishment and accordingly, consent terms are submitted before State Commission.  For purpose of identification  said consent terms are marked as Exhibit-X.    In view of this, we pass following order:-

:-ORDER-:

 

1.                 Appeal is allowed.

2.                 Amount of Rs.3,39,316/-  deposited wit the State Commission be released in favour of respondent nos. 1 to 4.  If the office has deposited the said amount in the Nationalized bank, interest if any, accrued on said amount be paid to respondent nos. 1 to 4.  Since the dispute between the appellant and respondent has been settled, an order of simple imprisonment for period of one year is hereby quashed and set aside.     

3.                 Registrar is directed to release the said amount in favour of the respondent nos. 1 to 4. 

4.       No order as to costs.

5.      Copies of the order herein be furnished to the parties.
