Brief Facts of the case
Complainant purchased a DVD writer HP 1000printer vide No.CN1C722K5W with a Kingstone Pen Drive 16GB from OP on 01/02/2013 for a sum of Rs 3100 vide invoice no. BSM/RI/46555.
The said printer did not work properly from day one so complainant intimated OP for non functioning and said that he had been sold a defective printer. When he did not get any reply, so he lodged his complaint on HP Customer care centre on 27/08/2013. Later he was told that the said printer warranty had expired on 08/03/2013. S
As per complaint, complainant was assured for repair or refund if any defect not repairable. But he could not get any response from OP. Finding deficiency in the services of OP, he filed this complaint. He claimed for refund of the cost of printer along with 18% interest. He also claimed compensation of a sum of Rs 25000/- with Rs 21,000/- as litigation charges.
Complaint was scrutinized. Notice was served, but none put up their appearance. Again notice was served. OP advocate appeared and after receiving the copy of complaint, filed one application pleaded some more time to file written version on 10/01/2014. Since then no one appeared nor submitted any written version or evidences on affidavit. Complainant was directed to file evidences on affidavit.
However, none of the parties filed their evidences nor did OP filed its written statement.
After perusal of complaint and merits of the case, we come to the conclusion that the present complaint is devoid of merit and deserve dismissal. Hence complaint is dismissed without any cost.
The order copy be sent to the parties as per rules and file be consigned to the record room.
