The Ld.Counsel on behalf of the complainant has filed the petition stating in that petition that the case has instituted against the opposite party i.e. the Branch Manager, Bank of India, Gumla Branch, for deficiency in service and wrongly deducted Rs. 1, 80,000/-(Rupees One Lakh Eighty Thousand) as TDS from his account without any reason. The Ld.Counsel further submitted that the opposite party Bank has remitted the said amount which was deducted from the account of the complainant. The Ld.Counsel has further submitted that as the deducted amount has already remitted in the account of the complainant, therefore, the complainant of this case doesn’t want to proceed against the opposite part Bank. It has prayed to dispose of this case on the basis of settlement with the Bank.
We have heard the Ld.Counsel on behalf of the complainant and after perusal of this consumer complaint, we find here that the complainant Namely Jageshwar Sahu has instituted this consumer complaint against the Branch Manager, Bank of India, Gumla Branch for deficiency in service on its part regarding deduction of Rs. 1, 80,000/-(Rupees One Lakh Eighty Thousand) as TDS from the account of the complainant. The notice has issued to opposite party Bank but till today nobody appeared from the opposite party Bank. Now the matter has already been settled outside of the court. The amount deducted by the opposite party Bank from the account of the complainant has been remitted in his account. The Photocopy of Bank Statement is annexed with the petition today on behalf of the complainant.
As the matter has already been settled between the complainant and the opposite party and the complainant doesn’t want to proceed with this case, therefore, on the basis of the above mentioned facts and settlement took place between the parties of this case, the petition filed on behalf of the complainant is hereby allowed. This consumer complaint filed by the complainant namely Jageshwar Sahu against the Branch Manager, Bank of India, Gumla Branch is hereby disposed of on the basis of settlement and the case is hereby disposed of accordingly.
