                        Sh. ML Sardana, Advocate for OP.

                     No evidence was produced by complainant. However counsel for the complainant desired to withdraw the complaint maintaining that he came to know that the amount of FDR has already been received by the complainant. To this effect statement of counsel for the complainant recorded separately. Sh. ML Sardana, counsel for the OP objected stating that the FDR amount had already been received by the complainant before filing the complaint but despite that he had filed the frivelous complaint for which OP had to engage the counsel & paid fee of sum of Rs.15,000/- and also suffered mental pain agony and prayed that complaint be dismissed with heavy costs.

           Perusal of the file reveals that the complaint in hand was filed on 05.08.2019 whereas complainant has filed an application on 12.03.2001 seking to release the amount of FDR before the insurance policy. Meaning thereby complaint was filed much before getting the FDR amount and thus in view of his statement, the present complaint stands dismissed as withdrawn File be consigned to the record room after due compliance.
