Today is fixed for admission hearing.
After hearing the Ld. Advocate and perusing the material on record we find that the main grievance of the complainant is against some unknown persons who duped her of Rs. 50,999/- on 05.09.2020. This is why the complainant launched EC PS No. 53/2020. It has been alleged by her that actually she wanted to purchase Chelo Kabab from “Peter Cat” Restaurant of Park Street and some unknown persons pretending to be workers or agents of Peter Cat Restaurant took the payment of Rs. 50,999/- from the complainant. Not that any role was played by the bank or its officers in the aforesaid fraudulent transaction involving Rs. 50,999/-.
It appears that the complainant lodged complaint with OP Bank on 07.09.2020. She also lodged cyber claim on and after 15.05.2021 and after gap of sometime she filed claim application before the insurer. But nowhere it has been mentioned that the bank or its officers helped the wrong doers to extract Rs. 50,999/- from the complainant.
Cheating was done by some unknown persons without any assistance or help from the bank. It is hard to understand where any charges were paid by the complainant in connection with the account maintained bank for achieving such an additional service. So the case as framed as against the OPs does not merit acceptance.
The OPs cannot be made to extend relief to the complainant in such a case under such a situation.
The claim against the OP as raised is not actionable at all.
Hence, it is ordered that :-
The case be and the same is dismissed as being not admitted.
Let plain copy be given to the parties free of cost as per CPR.
