Today is fixed for admission hearing.

After having heard the Ld. Advocate and having adverted to the material available on record, we see that the complainant has filed this case against Bank of Baroda. The allegation is that the Bank has not taken any steps for causing refund of Rs. 10,000/- (Rupees ten thousand) which was mistakenly been deposited with another customer’s account. The allegation suffers from inherent inconsistency. Deposit was made by the complainant not in favour of the bank but at the credit of another’s account attached to the bank. There is hardly any case of deficiency in rendering service on the part of the bank. So, the case has no leg to stand upon. It is fit to be dismissed.

Hence, it is ordered, that the case be and the same is dismissed as not being admitted.

Let a plain copy be given to the parties free of cost as per CPR.
