Today the case was fixed for filing evidence on behalf of the complainant. Shri Anshul Goyal, counsel for the complainant has filed an application for file put up in Lok Adalat.
Shri Anshul Goyal, counsel for the complainant has made a statement that “I press only for harassment, interest and litigation expenses and any other relief if the Commission may given to the complainant.
On the other hand, Ms. Levanshi Mangla, counsel for opposite party No.2 has made a statement that “I being the authorized representative of Insurance company i.e. opposite party NO.2, ready to pay the harassment, interest and litigation expenses, claimed by the complainant in the present matter. A period of 15 days may kindly be granted for the said purpose.”
The complainant has prayed in her complaint to release sum assured amount of Rs.2,00,000/- (death benefits Pradhan Mantri Jivan Jyoti Bima (Yojna) alongwith @ 18% per annum to the complainant immediately.
On the other hand, counsel for opposite party submitted in his written that that the present complaint is not maintainable as the claim amount of Rs.2,00,000/- has already been paid to the nominee towards the settlement of the death claim, the amount is settled in favour of vijay Laxmi Aggarwal i.e. complainant being the nominee under the policy.
Keeping in view of the statement of both the parties as well as submissions, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party No.2 to pay Rs.3300/- as compensation for causing mental agony & harassment alongwith Rs.2200/- as litigation expenses to the complainant. Compliance of this order be made within 30 days from the date of receipt of copy of this order. Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
