Per Shri S.R. Khanzode – Hon’ble Presiding Judicial Member:

 

Heard both sides on delay condonation application.  There is delay of 31 days in filing the appeal and the reasons stated are that when the impugned order was passed, the Complainant was not in town.  He came to know about it belatedly and hence, there is delay.  The delay is marginal one and neither intentional nor any malafide could be attributed since the appeal is to be decided on its own merit.  Considering this aspect we are satisfied with the reason given to condone the delay.  Hence, the Misc.application No.2516/2005 filed for condonation of delay is allowed.  Delay in filing the appeal is condoned with no order as to costs.
