Petitioner had taken certain FDRs in the year 1987 which was matured in the year 1992, and, thereafter no request was made for renewal of the FDRs by the depositor.  The FDRs which were lying with the petitioner were seized by the CBI.  Therefore, the Bank could not encash the FDRs along with interest.  Petitioner filed a complaint before the District Forum.  District Forum dismissed the complaint.   Being aggrieved, petitioner filed an appeal before the State Commission.    The State Commission in appeal upheld the order passed by District Forum.  The State Commission has stated that after maturity, no request had been made by the petitioner for renewal of the FDRs by the depositor.  Relying on the circular issued by the respondent – Bank regarding overdue deposits, it was held that on the deposits after the date of maturity interest could not be paid unless renewed.  The FDRs were in the possession of CBI, the Bank was not in a position to renew them.

We agree with the view taken by the State Commission.  Dismissed.
