Final Order/Judgment

Both parties file hazira through Ld. Advocate. The case is fixed for argument. After hearing argument/ written argument the Commission proceeds to dispose of the case as here under.

            The Complt. case is that he being a primary school teacher took loan of Rs. 1,20,000/- in the year 2004 vide CPLS no. 153 dated 14.09.04, Rs. 1,70,000/- in the year 2006 vide CPLS no. 226 dated 22.05.06, he took loan of Rs. 2,15,000/- in the year 2008 vide CPLS no. 340 dated 05.05.08, Rs. 2,04,000/- in the year 2009 vide CPLS no. 250 dated 28.02.09, Rs.1,50,000/- on 18.11.09 vide CPLS no. 262, Rs. 1,50,000/- on 21.12.10 for various purpose and the entire loan amount has been clear after closing the loan account. There after the Complt. took loan of Rs.5,00,000/- on 16.11.2019 vide loan account no. 5205300000151 payable under 180 EMI @Rs.5,800/- which was deducted from time to time from the salary account of the Complt. till august 2011 and thereafter in view of Govt. notification the Complt, paid EMI directly to the O.P bank at his own. Though the Complt. went on paying the EMI of loan amount from time to time but the O.P bank sent demand letter dated 14.12.2017 to the Complt. and the copy of the said letter has been sent to the District Inspector of School, Paschim Midnapore and also to the Manager SBI Gopiganj branch. The Complt. having been humiliated and harassed by such letter sent protest letter to the school authority and the bank authority with regard to the loan matters. Hence this case

            O.P bank contested the case by filing a written version contending interalia that the Complt. is a defaulter of loan amount and the matter was brought  to the notice of the appointing authority of the Complt. without any demand for recovery of the loan amount and as such the Complt has nothing to hurt from such letter.

Decision with reason:-

Having regard to the fact of the case, contention submission and documents on both sides the Commission finds that admittedly the Complt. being a Primary teacher is a defaulter of loan and earlier loan amount was to be deducted from the salary account of the Complt. within the control of the School authority and as such it is not a misplaced steps on the part of the O.P bank to sent copy of the letter in question to the school authority merely for information and it is not an act of deficiency of service and unfair trade practice on the part of the O.P bank by sending such letter to the School authority without having any malafide intention to hurt the sentiment of the Complt. It is not a Consumer dispute at all and the O.P bank cannot be held liable for the same. However O.P bank should refrain from making any correspondence with regard to the loan matter of the Complt. with any other authority save and except taking legal action in accordance with law and / or settle with the Complt officially.

                  Hence it is,

Ordered.

 

that the case be and same is dismissed on contest devoid of merit. However the O.P bank is directed to take up officially with the Complt. the settlement of loan account on furnishing statement of account in due process of law. Both parties be supplied copy of this order free of cost
