             Learned counsel of the parties are present.

             From the side of the complainant a prayer U/O XIII Rule 1 CPC is filed for withdrawing the case with liberty to file fresh suit.

           Perused the petition. It is stated in the petition there being some formal defects in the paint/complaint, the complainant seeks to withdraw the case with liberty to file fresh suit.

             Heard learned counsel of the parties on the said prayer.

             Prayer of the complainant to withdraw the case is allowed.

            Complainant is permitted to withdraw the case with permission to file the same afresh if so advised. The case stands disposed of.
