Allegedly, the complainant being a motor mechanic had taken one shop on rent from opposite parties in the year 2014 @ Rs.500/- per month and since then is paying rent and electricity charges to opposite parties but no receipt is being issued by the opposite parties. It is further alleged that the electricity meter is in the name of Sh.Som Lal. Opposite parties are not issuing him rent receipt and are rather threatening him to eject him and demolish the shops by throwing his articles lying in the shop.

2.       The question for determination for admission of the complaint in this Commission is as to whether the complainant is a consumer of opposite parties. In order to prove this fact, the complainant has placed on the file documents, copy of jamabandi for the year 2017 of village Gazikot, Tehsil Dinanagar, District Gurdaspur and copy of bill of electricity. But both these documents do not show that the complainant is a consumer of the opposite parties. Third document placed on record by the complainant is copy of the complaint filed by him in the Court of the Sub Divisional Magistrate, Gurdaspur U/S 107/151 CrPC. But this document is also not relevant to prove that the complainant is a consumer of the opposite parties. Hence, from the documents placed on file, it is not established that the complainant is a consumer.

3.         In view of our aforesaid discussions, the complainant being not a consumer, this complaint is not maintainable before this Commission. As such the same is dismissed being not maintainable.

4.       Copy of the order be communicated to the parties free of charges. After compliance, file be consigned.
