Learned counsel for respondent as well as respondent states that there is no objection if the impugned order passed by the State Commission as well as District Forum is set aside and the present revision petition is allowed.  However, liberty may be given to the respondent/complainant to seek appropriate relief before appropriate forum.

          In view of the above statement given by the learned counsel for respondent as well as respondent, present revision petition is allowed and the impugned order passed by the State Commission is set aside and the complaint filed by the respondent/complainant before the District Forum shall be deemed to have been dismissed.

          Liberty as prayed for is given to the respondent to seek appropriate relief before appropriate forum. Respondent can claim benefit of Article 14 of the Limitation Act, in accordance with provisions of law.

          With these observations, present revision petition stand disposed of.
