HON’BLE JUSTICE SRI A. CHAKRABARTI, PRESIDENT.

 

Heard Mr. Kajal Sen, the Ld. Advocate for the Revision Petitioner.  The only contention of the Revisionist is that on the death of one of the owners the Power of Attorney has lost its life and, therefore, the Revisionist is unable to execute the Deed of Conveyance.  It appears that this contention has not been raised before the Forum below and in the circumstances we do not find any irregularity on the part of the Forum till now.  In the circumstances we dismiss the revision petition.  We make it clear that we have not decided any of the questions raised in the revision petition on merit and Petitioner is at liberty to bring it to the notice of the Forum in appropriate manner and the Forum will be entitled to decide the question if raised before the Forum.
