Although as per the office report, Respondent remains unserved but Ms. Shantha Devi Raman, Advocate has put in appearance on its behalf. She states that she will file her vakalatnama within one week from today. Let her do so. At the outset, learned Counsel appearing for the Complainant states that as per her instructions, in order to avoid any further delay in -2- the disposal of the Complaint, the Complainant has no objection if some reasonable time is granted to the Appellant to file its Written Version provided the Respondent/Complainant is adequately compensated for the delay already caused in the disposal of the Complaint. In view of the afore-said submission, the Appeal is allowed with a direction that if the Appellant files its Written Version within 30 days from today, the same shall be taken into consideration, subject to the Appellant’s paying to the Complainant a sum of ₹10,000/- as costs and depositing a further sum of ₹10,000/- in the Consumer Legal Aid Account maintained by this Commission within four weeks. It will be open to the Complainant to file Rejoinder Affidavit and additional evidence by way of affidavits, if so advised, within four weeks of the date of receipt of the Written Version. Thereafter, the Appellant shall file its evidence by way of affidavits within six weeks thereafter. The Appeal stands disposed of in the above terms. |
