ORDER

1.   Office report seen. Heard. Be registered. The present miscellaneous application has been filed on behalf of applicant/complainant/DH namely Sukhpal Singh for releasing the amount in his favour, which was deposited by JDs with this Commission i.e. Rs.3,00,000/- on 26.07.2023, Rs.1,50,000/- on 16.08.2023 and Rs.4,00,000/- on 18.09.2023 in execution application No.2 of 2023. The learned counsel for applicant/complainant/DH has given the bank details of the applicant/complainant/DH as ‘Punjab & Sind Bank, Sector 17, Chandigarh, Saving Account No.06001000020256, IFSC Code PSIB-0000600.

2.   As per office report, the JDs have deposited Rs,4,00,000/-, Rs.3,00,000/- and Rs.1,50,000/- (total Rs.8,50,000/-) with this Commission and FDR for the same has been prepared.

3.   Sh.Shubham Tandon, Advocate for Sh.Navjot Singh, Advocate for Non-Applicant/JDs/Accused accept notice of the application and made statement, recorded separately, that as per the instructions of the JDs/Accused, he has no objection if the amount of Rs.3,00,000/-, Rs.1,50,000/- and Rs.4,00,000/-, deposited by JDs/Accused with this Commission, be released in favour of complainant/DH alongwith interest accrued thereon.

4.   In view of the no objection made on behalf of non-applicant/JDs, the miscellaneous application is allowed. It is ordered that the amount of Rs.3,00,000/-, Rs.1,50,000/- and Rs.4,00,000/-, lying deposited with this Commission in the shape of FDR, alongwith accrued interest thereon, be transmitted in the aforesaid bank account of the applicant/complainant/DH, against proper receipt & identification. Office to take necessary action for release of the amount. Office should ensure the correctness of the bank account details of the applicant/complainant/DH before getting the amount transferred in his account. The present miscellaneous is disposed of accordingly. It be tagged with the execution application file bearing EA No.2 of 2023.

5.   Certified copies of this order be sent to the parties free of cost.
