Final Order / Judgement

Order No. 03   Date - 29.01.2021

Record is put up for order.

The matter was heard on 27.01.202.

On perusal of the cause title of the consumer complaint it appears to us that all the OPs are carrying on business outside the territorial jurisdiction of this Commission. Complainant also an inhabitant of Rajarhat which is also outside the jurisdiction of this Commission. Complainant claiming that he is working for gain at 41, A J. C Bose Road, Kolkata 700 017,  PS : Park Street but in support of such claim he has not file his photo identity card issued by his employer and / or DDO to establish his place of posting.

Considering the above aspect, we are not inclined to admit the complaint on the point of jurisdiction and the complaint is dismissed in limine.

Complainant may agitate his grievance before the competent Commission having its territorial jurisdiction, if so desired.

In view of the above observation the prayer U/s 34 (2) (b) of the CP Act, 2019 is not tenable and rejected.

Thus, MA being No. 07 of 2021 is disposed of.
