ORDER

SRI. P.V. JAYARAJAN,  PRESIDENT:

1. This is a complaint filed under section 12 of Consumer Protection Act 1986.   This complaint is with regard to the purchase of a Panasonic LED TV from the opposite party and alleging deficiency in service on the part of the opposite parties, the complainant approached this commission for necessary relief.
2. The opposite parties filed version on 09.07.2018.  Subsequently the complainant filed chief affidavit on 31.08.2018.  As the complainant was not able to come before this commission a fresh chief affidavit was filed by her husband as the authorised person of the complainant on 12.02.2020.  Subsequent to that there was no representation for the complainant till 13.11.2020.  Hence this commission issued notice to the complainant to appear before this commission on 08.01.2021.  The notice issued to the complainant was returned with endorsement “not known”.  Hence the commission on 08.01.2021 granted one more chance for the appearance of the complainant on 08.03.2021.  On 08.03.2021 also there was no representation from the side of the complainant.  Sufficient opportunities were granted to the complainant by this commission to establish her case.  It is evident that the complainant has not taken due diligence in prosecuting the complaint before this commission.  In spite of giving sufficient opportunities the complainant has not adduced any oral or documentary evidence to establish her case.  Hence we find that the complainant has miserably failed to establish her case.
3. In the result the complaint is dismissed.  No order as to cost.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
