Complainant called out absent. No representation on behalf of the complainant.

OP counsel opposed the adjournments.  On perusal of the order sheet, it is noticed that on the last date of hearing i.e. 14.12.2022 this Commission had observed that this case was stand posted on 23.04.2020 for filing affidavit of complainant since then till today in spite of giving sufficient opportunities more than 2 ½ years, complainant does not turned up and not shown any interest to file affidavit.  However, considering the nature of the complaint, this case adjourned to this day on payment of cost of Rs.2,000/- and posted the matter for fling affidavit of complainant as last and final chance. 

Even then complainant not present and not paid cost nor filed affidavit, it shows that the complainant is not interested to proceed with the complaint. 

In view of the non-filing of the affidavit by complainant, it is clear that the complainant has failed to prove his complaint.  Therefore, the complaint of the complainant is dismissed for default as well as non-prosecution.
