CONSUMER COMPLAINT NO. 386  OF  2020

AWARD

1.   Vide his separate statement recorded on 05.09.2023, Sh.Gaurav Bhardwaj, Counsel for OP No.1 has stated that the matter has been amicably settled between the parties and as per settlement, the OP No.1 shall pay a lumpsum amount of Rs.20,000/- to the complainant within a period of 4 weeks from today(05.09.2023) in full and final settlement of the present matter, failing which the OP No.1 shall be liable to pay the aforesaid amount alongwith interest @ 12% p.a. from the date of filing of present consumer complaint. Counsel for OP No.1 has further stated that the OP No.1 will also get the CIBIL status of the complainant qua OP No.1 & 2 updated/corrected within 4 weeks from today(05.09.2023). Vide his separate statement, the complainant has admitted the aforesaid statement of counsel for OP No.1 and stated that he will provide the information to the CIBIL with regard to rectification of the loan details wrongly assigned with his account, if need be and prayed that the present consumer complaint be disposed of in terms of aforesaid settlement in National Lok Adalat.

2.   In view of the statements and in terms of the settlement, the complaint stands disposed of by passing the following order:-

  1. OP No.1 shall pay a lumpsum amount of Rs.20,000/- to the complainant within a period of 4 weeks from 05.09.2023.
  2. In case OP No.1 fails to pay the aforesaid amount within the stipulated period, then OP No.1 shall be liable to pay the same alongwith interest @ 12% p.a. from the date of filing of present consumer complaint i.e. 17.09.2020 till the payment is made.
  3. OP No.1 will also get the CIBIL status of the complainant qua OP No.1 & 2 updated/corrected within 4 weeks from 05.09.2023.
  4. Complainant will provide the information to the CIBIL with regard to rectification of the loan details wrongly assigned with his account, if need be.

 

3.   The award is accordingly passed.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
