The Complainant files hazira through advocate.
No step is taken by the O.P.s
O.P. s are found absent on repeated call.
The case is therefore taken up for ex-parte hearing.
The Complainant’s case is that he took a loan from O.P. No.1 under Agreement No. being 4D4DFS56757634, dt.28/10/2017 payable at monthly EMI of Rs.225/- through O.P.2/Bank under ECS Mode. Though the loan amount has been repaid and No Dues Certificate has been issued by O.P. No.1 but O.P. No.1has wrongfully demanded Rs.3,200/- instead of refunding extra ECS amount of Rs.225/-. The Complainant has therefore approached this Commission for appropriate relief.
The O.P. /Bank though appeared but did not file any written version. O.P./Financer in spite of service of Notice did not contest the case.

The Commission has examined the complainant’s case and all the materials on record. When No Dues Certificate has been issued by the O.P./Financer which is on record they cannot claim further amount towards the Loan A/c from the Complainant and so O.P./Financer is liable to refund the payment of excess ECS amount of Rs.225/- through O.P.2/Bank in favour of the Complainant.
Prima facie case is established.
Hence it is ordered……..
That the case be and the same is allowed ex-parte against the O.P.s
O.P./Financer is directed to refund Rs.225/- to the Complainant without claiming further amount of Rs.3,200/- within one month from this date in default law will take its own course.
Both parties be supplied copy of this Judgement free of cost.
