Complainant is present through lawyer.

The case is fixed for Admission hearing.

Perused the written complaint and other materials on record.

Heard the Ld. Advocate for the complainant.

The case is admissible from the point of view of territorial, pecuniary jurisdiction and also the period of limitation but the complainant has no prima-facie case to proceed against any of the O.P.s as neither O.P. No.1 i.e. Bajaj Finance Ltd. and O.P. No.2 i.e. M/s Ambika Auto Mart have any involvement in the receipt and deposit of the disputed amount of Rs.64,080/- which has been paid by the complainant and received by one Amit Roy representing as an Agent of O.P. No.1.

There is no material on record to show that said Amit Roy is associated with any of the affairs of O.P. No.1 & 3. The framing of the case and naming of the parties are not proper in form.                                                                                              Contd…….p/2

Hence the case is not admissible in consideration of the prima-facie facts of the case.

Hence it is ordered……

That the case is dismissed as being not admissible.

Both parties be supplied copy of this judgement free of cost.
