Final Order / Judgement

Complainant Prasenjit Pramanik filed this case for a direction to the O.P. Bajaj Finance Ltd. to issue No Objection Certificate (NOC) for his two loan accounts 1st Loan A/c No. 4H10CD23624137 and 2nd Loan A/c No. 4H10CE26305181 along with Rs. 40,000 for compensation for mental harassment.

2          The case of the complainant in short is that he has taken some electrical items under finance by Bajaj Finance Ltd. having 1st loan account No. 4H10CD23624137 and 2nd loan A/c No. 4H10CE26305181. It has submitted he has paid loan amount but the O.P. has not issued NOC due to which his salary account has been blocked. It is also submitted even after payment of loan amount the advocate of the O.P. and the Delhi Police continuously harassing him.

3          The following document have been filed in support of his claim:-

Anx-1 to 1/ 2  Copies of the E-mail conversation.

Anx-2 NOC issued by O.P. in respect of loan account 4H10CD23624137

Anx-3 and 3/1 Copies of statement of loan account.

4          The O.P. M/s Bajaj Finance Ltd. has not appeared in spite of notice hence Ex-parte proceeding has been initiated.

                                                            F I N D I N F S

5          We perused the record and we hold since the complainant has taken loan from the O.P. and avail services on payment of money. Hence he is a consumer and the dispute is a consumer dispute.

6          Anx-2 is NOC relating to the first account No. 4H10CD23624137 and therefore, there is no need for issue of any direction for this account.

            So far, NOC for the second loan amount No. 4H10CE26305181 is concerned, Anx-3 series shows the complainant has paid the loan amount but the O.P. has charged for bouncing of the cheques which is about Rs. 6,336/- as on 27.03.2018. Thus, it appears that for getting NOC for this loan account, the complainant has to pay the due amount to the O.P.

            Therefore, we do not found any cause of action for the presence complaint. As such this complaint is not maintainable as having no merit and accordingly hereby dismissed.

            O.C. is directed to deposit the record in the record room.
