ORDER
PER SANJEEV BATRA, PRESIDENT
1. The complainant has invoked the jurisdiction of this Commission by filing the present complaint and raised a consumer dispute with regard to non-refund of amount to the complainant besides paying compensation of Rs.50,000/- and litigation expenses of Rs.11,000/-.
2. Notice was issued to the opposite parties and on 22.12.2020 Sh. Sumit Jain, Advocate filed power of attorney on behalf of the opposite parties along with written statement as well as affidavit and assailed the complaint on the ground of maintainability; mis-joinder and non-joinder of parties etc. The opposite parties denied the allegations levelled in the complaint by stating that the complainant is liable to pay the overdue amount for the loan accounts and also prayed for dismissal of the complaint
3. The parties have already led their evidence by tendering their respective affidavits and documents and the case was fixed for arguments.
4. However, on 04.09.2023, Sh. Sumit Jain, Advocate counsel for the opposite parties suffered statement that the company is ready to settle the both loan accounts of the complainant for a total lumpsum amount of Rs.35,000/ - as settlement amount. After payment of the total amount by the complainant, the NOC will be issued by the company.
5. In pursuant to the same, the complainant has also suffered a statement that he has two active loan accounts with Bajaj Finance Limited with account bearing No.426MPDFV585360 and 426PSTEO420848. Total outstanding in loan account No.426MPDFV585360 is Rs.68,722/- and against loan account No. 426PSTEO420848 is Rs.2,05,214/- and he is ready to pay Rs.35,000/ - as settlement amount in above two loan accounts as offered by the company. Further he got recorded his statement that he will pay Rs.15,000/- on 25.09.2023 and remaining Rs.20,000/- on or before 23rd October 2023 and in case, he fails to pay the above said amount in the said period, then he will pay interest @9% per annum on the total outstanding loan amount.

In view of the aforesaid settlement arrived between the parties, the present complaint stands disposed of with direction to the complainant that he will pay Rs.15,000/- on 25.09.2023 and remaining Rs.20,000/- on or before 23rd October 2023 and in case, he fails to pay the above said amount in the said period, then he will pay interest @9% per annum on the total outstanding loan amount. Thereafter, the opposite parties shall issue NOC to the complainant within 30 days from the date of receipt of second payment from the complainant i.e. on 23.10.2023. Copy of the order be supplied to the parties free of costs.
7. File be indexed and consigned to record room.
