This is an appeal preferred by the unsuccessful complainant against the order of dismissal of his complaint for default.
The plea was that he was suffering from typhoid and could not go the Forum to represent the matter.
Considering the fact that the complainant is aged about 89 years, an advocate, and the complaint being dismissed for default, we are of the opinion that one more chance could be given to the complainant in order to pursue the matter. Since the opposite party has put in its appearance through counsel, both parties are directed to appear before the District Forum on 10.09.2012 without insisting for fresh notice.
The District Forum is directed to restore the complaint to its original file and direct the opposite party to file its written version within the time stipulated and after receiving affidavit evidence from both sides dispose off the matter within three months from the date of this order.
The appeal is disposed off accordingly. No costs.
