Appellant- Mr. Sudhakar as well as his counsel Mr. Ghonge are absent. None for the respondents is present. On 02/01/2013 notice after admission was issued to the respondents but till today no report about service of notice is received. The office copy of notice reflects that it was issued on the correct address of the respondents as shown in the appeal memo. Therefore it will have to be presumed that the respondents are served with notice but they are absent. Hence, appeal is required to be proceeded expate. However, as the appellant as well as his counsel are absent since last date, the appeal deserves to be dismissed in default. It be recalled at 3.00 p.m. for order.


 

Matter is recalled at 4.45 p.m. but nobody for the appellant turned up. Hence, the appeal is dismissed in default. No order as to cost.
