             Complainant  filed this complaint for getting compensation and cost and also  for getting direction to the 2nd opposite party  to give financial  assistance to the complainant .

Though 1st  opposite party filed version, they did not adduce any evidence before the forum.  2nd opposite party after getting notice  did not  appear before the forum.  Hence  both the opposite parties were set-exparte.

            Complainant  filed chief  affidavit  and  8 documents.  The documents were marked as Ext.P1 to P8.  Here  the complainant did not produce any document  to prove that he  applied for the loan in Syndicate  Bank (OP2) and  they  refused the loan.  From  the documents  it  is seen that Mr. Shihabudeen  had made payment  of  the due amount  Rs. 2288 to the 1st  opposite party on 26.11.2010.  From the available evidence it is evident  that  Mr. Shihabudeen has made  default in making the payment  of the agreed installment dues of Rs. 2288/- and remitted  it only on 26.11.2010.  Opposite party 1  contented  that they have taken steps after the remittance  of due amount to writ off  tag as zero.  But  there is no evidence  to show that after the remittance, what steps, taken by the  1st opposite party to write off  tag as zero.  Since there is no evidence from the side of opposite party 1,  we are of the view that there is deficiency in  service on the part OP1.

The Forum  is having  no right to give direction  to the  2nd opposite party to give  financial assistance  to the complainant.  It is their  discretion to give loan etc.

            In the result, the complaint is allowed in part.

            Opposite  party  is directed to give Rs. 10,000/-  as compensation to the complainant for their  deficiency  in service in  non-taking  steps to the complainant’s status in  CiBiL Report  as zero.  Opposite party 1 is also directed  to give Rs. 1500/- as cost  to the proceedings.  The order is to be complied with within one month after receipt of this order.
