ORDER:                    

 

                Today the complaint is fixed for consideration on the point of admissibility.

2.                    The complainant has filed the present complaint u/s 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as ‘OPs’) on the averments that in the month of March, 2019, on the allurement of representative of OPs that complainant has to pay premium amount upto 5 years and after completion of 5 years, the premium amount would become definitely double, the complainant purchased Life Insurance Policy and paid first premium amount of Rs.99,900/- to the OPs. The complainant was shocked when she received original policy documents at her address and found that the said policy relates to Pension Plan under the name and Style of “Retire Rich”. After coming to know about the said fraud, the complainant approached the OPs for cancellation of said policy and for getting back the premium amount.  Then the OPs told that complainant must continue her aforesaid policy upto five years and after completion of five years, the complainant can get back her policy withdrawn alongwith premium amount deposited by the complainant. Believing upon the assertions of the representative of OPs, the complainant deposited premium amount regularly for five years and deposited total amount of Rs.4,99,500/- till 29.03.2023. After lapse of five years, complainant approached the OPs and requested for getting back the premium amount alongwith interest and bonus, the representative of the OPs told that the said policy relates to pension plan and the premium amount which has been deposited would be returned after completion of seven years in shape of monthly pension. The complainant approached the OPs number of times to return the premium amount alongwith interest and bonus, etc. but they flatly refused to return the same. Hence, the present complaint.

3.             Learned counsel for complainant argued that the complainant has purchased the insurance policy on the allurement of representative of the complainant who told that the premium amount would be doubled in five years, but on receiving the policy, the complainant came to know that fraud has been committed with her, then again she approached the OPs and then they gave false assurance to the complainant that after five years she will get the premium amount alongwith interest and bonus, but now after lapse of five years, they are refusing to return the premium amount alongwith interest and bonus, thus, there is deficiency in service and unfair trade practice on the part of the complainant and lastly prayed for issuing notice to the OPs.

5.             The complainant had purchased the policy in question on 28.03.2019 and the date of maturity of the policy is 27.03.2026. The complainant has alleged that on the allurement of representative of the OPs and if it is so, then why the complainant did not close/cancel the policy in question within free look period.  It is admitted that the terms and conditions were supplied to the complainant immediately after purchase of policy in question in the year 2019. It seems that the story put forward by the complainant is concocted one and the present complaint has been filed just to harass the OPs and to waste the precious time of this Commission. Moreover, the complainant has not placed on file any documents from which it can be ascertained that there is any truthfulness in the story of the complainant.

6.             Thus, in view of the above discussion, the present complaint is devoid of merits and deserves to be dismissed and same is hereby dismissed in limine. No order as to costs. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
