JUDGEMENT
The present disputes emerges out of the grievance raised in the complaint petition filed by the above named complainant alleging deficiency in service against afore mentioned O.Ps for non payment of accident vehicle Ford eco sports Car bearing Registration No. OD-18-A-1505 towards repair cost vide insurance policy No.1600008004 for which the complainant sought for redressal of the grievances raised by the complainant.
Upon Notice, the O.P No.1 & 2 put in their appearance and filed written version through their learned counsel in which they refuting allegation made against them. The O.P No. 1 & 2 taking one and another pleas in the written version sought to dismiss the complaint as it is not maintainable under the C.P. Act, 1986. The facts which are not specifically admitted may be treated as denial of the O.P No. 1 & 2. Hence the O.P No.1 & 2 .prays the forum to dismiss the case against them to meet the ends of justice.
During the course of hearing both the parties are appeared before the forum and filed a memo where in both the parties were signed . In the above memo both the parties are submitted that we have arrived at a compromise to settle the above mentioned claim petition at Rs. 1,26,000/- (Rupees one lakhs twenty six thousand)only towards full and final satisfaction of the claim. Further both the parties are prayed the forum to record the compromise memo and pass an award accordingly. The Insurance company is willing to issue a cheque for the said amount within three months of the passing of the award .
Heard from the parties. Perused the records submitted by the parties. Memo is allowed.
Considering the exigencies of the case the Memo filed by the parties is allowed.
ORDER.
The O.Ps are directed to issue cheque a sum of Rs.1,26,000/- in favour of the complainant within one month from the date of receipt of this order.
In the peculiar circumstances there is no order as to costs.
Copies of the order be served on the parties concerned as per rule.
