Suresh Mehta (aged about 32 years) son of Shri Devi Lal, resident c/o S.M. Computers, Sapra Street, Sadar Bazar, Sirsa, Tehsil and District Sirsa.

                                                   O R D E R

          This order shall dispose of afore-mentioned appeals bearing No.231 & 557 of 2015 filed by Suresh Mehta- complainant and Bajaj Allianz Life Insurance Company Limited (for short ‘Insurance Company’)-opposite party respectively because they have arisen out of common order dated January 15th, 2015 passed by District Consumer Disputes Redressal Forum (for short District Forum), Sirsa, in complaint No.278 of 2011.

2.      Complainant purchased Bajaj Allianz Care First policy.  The sum insured was Rs.2,00,000/-.  On May 07th, 2011, he met with an accident and got injured.  He took treatment from Sangwan Hospital, Gangaji Hospital and Jan Nayak Chaudhary Devi Lal Dental College, Sirsa.  He submitted claim of Rs.2,15,025/- with the Insurance Company on August 25th, 2011 but the same was repudiated on the ground that claim was filed beyond the period of 60 days after his discharge from the hospital. 

3.      The District Forum allowed the complaint.  Operative part of the order reads as under:-

          “13.   Resultantly, this complaint is hereby allowed, with a direction to the opposite parties, to pay total sum of Rs.20,000/- to the complainant with interest @ 9% per annum, from the date of accident dated May 07th, 2011 till payment.  The complainant is also hereby awarded compensation of Rs.2,000/- for his harassment, mental tension etc and litigation expenses of Rs.550/- against the opposite parties.”  

4.      Complainant purchased insurance policy Exhibit C-1.  He met with an accident on May 07th, 2011.  The District Forum awarded Rs.20,000/- alongwith interest at the rate of 9% per annum to the complainant on account of having injuries received in the alleged accident.  The District Forum has not accepted the medical bills produced by the complainant.  Be that as it may, there is a certificate of Sangwan Hospital, Sirsa wherein it has been stated that complainant remained hospitalized from May 07th, 2011 to May 08th, 2011.  Thereafter he was admitted on May 12th, 2011 and discharged on May 27th, 2011, that is, in all, he remained hospitalized for about 16 days.  It is not possible to collect each and every bill and the expenses incurred at the time when a person is hospitalized.  Taking into consideration the period of hospitalization, amount of Rs.20,000/- awarded by the District Forum to the complainant is just and reasonable.

5.      In view of what has been stated above, both the appeals are dismissed.     

6.      The statutory amount of Rs.14,950/- deposited at the time of filing the appeal No.557 of 2015 be refunded to Suresh Mehta-complainant against proper receipt and identification in accordance with rules, after the expiry of period of appeal/revision, if any.

7.      The original order is attached with appeal No.231 of 2015 and certified copy be attached with appeal No.557 of 2015.
