ORDER

 Learned counsel for the Op No.1 closed the evidence after tendering affidavit/documents Ex/RW1/A and Annexure R1 and Annexure R2.

                             Learned counsel for the complainant made a statement that due to technical defects he does not want to pursue with the present complaint and requests to file the same afresh before appropriate authorities after curing the defect. In view of above statement of the learned counsel for the complainant, present complaint stands dismissed as withdrawn. However, the complainant is at liberty to file fresh complaint/case before competent authorities and in that eventuality, the period of litigation before this Commission shall not be counted towards the period of limitation.  Exemption of time spent before this Forum is also granted  in terms of the  judgment of the Hon’ble Supreme Court of India in the case titled “Laxmi Engineering Works versus PSG Industrial Institute  (1995) 3 SCC page 583.Original  documents, if any, be returned after placing the photocopy of the same on the case file. File be consigned to record room after due compliance.
