ORDER

File taken up today on the application moved by learned counsel for OP-respondent. Learned counsel for the OP/respondent i.e. OP-Insurance Company tendered a statement before the Commission that the sum insured in this case is Rs.3 lacs out of which sum of Rs.1,15,650/- is to be paid by the complainant to the financer being outstanding amount of the vehicle insured i.e. Bajaj Finance Corporation Limited. Now, the respondent Op shall pay the above said amount to the financer and the remaining amount of Rs.1,84,350/-  shall be paid to the complainant by the Op within  45 days. On the other hand, learned counsel for the complainant also tendered a statement before the Commission that keeping in view the statement of learned counsel for the OP/insurance Company, he does not to proceed further with the complaint and withdraws the same.

                   In view of the statements so tendered by both the parties, the present complaint is disposed of with a direction to the Op-insurance company to make the payment of remaining amount of Rs.1,84,350/ to the complainant within 45 days from today failing which OP-Insurance Company shall be liable to pay interest at the rate of 12 % per annum for the period of default. Both the parties shall remain bound by their respective statements. Copy of this order be supplied to the parties free of costs. File be consigned to the record room after due compliance.
